The incumbent is responsible for overseeing an assigned portfolio of files pertaining to an array of employee complaints filed by non-Canadian based employees. Additionally, overseeing and conducting where appropriate, workplace reviews and climate assessments, to assess workplace culture. More specifically, the manager (also an investigator) will represent the Human Rights and Harassment Office and contribute to a harassment and discrimination free environment by:
  • Ensuring they are familiar with legislation on discrimination, harassment and retaliation, as well related U.S. legislation
  • Ensuring they are familiar and comfortable with the Company’s applicable policies (from both a legal and procedural standpoint); and
  • Collaborating with all involved parties, at both the formal level during an investigation, and informally, should it be determined that an attempt for resolution of the matter should first be made prior to a formal investigation. 
Key Functions and Accountability: Reporting to the Senior Director, Human Rights and Harassment, and supporting all matters related to non-Canadian based human rights and harassment at Air Canada, the manager (investigator) will:
  • Provide coaching, training, guidance and expertise to the required employee groups (unionized and/or management), on information contained in applicable workplace policies, and on specific issues related to discrimination, harassment, violence, retaliation in the workplace.
  • Strategize on collaborative ways to engage with internal and external bodies (i.e. US – Business Partner/Labour Relations/Legal Counsel), to best educate and support the needs of various workplaces in the area of harassment, etc.
  • Have oversight of the investigation process, including any legal requirement covered under said process. This may include meetings, interviews with participants in a formal complaint (including complainant, respondent and any witnesses) and preparing any necessary documentation needed for the participants’ signature throughout the course of the investigation.
  • Be accountable for providing substantiated and concise documentation for each case file that is clear and properly representative of the facts and can be easily used by all decision-makers. 
  • Stay abreast of updates and changes to case law pertaining to harassment and/or discrimination
  • Work with local management following the completion of an investigation, to obtain updates of the parties and conduct a follow up regarding the implementation of recommendations made in the investigative report. 
  • Provide guidance to team members and managers on issues of misconduct and other related concerns. 
  • Have oversight for the compilation and data analysis related to filed complaints, to identify opportunities for improvement in workplaces which have ongoing and/or systemic issues. Collaborate with Human Rights and Harassment Advisor and Senior Director to discuss these workplaces, and ensure information is freely shared among the team.
  • Develop, contribute and participate in appropriate work-related initiatives that promote a harassment-free and discriminatory-free environment and encourage awareness about the role of the Human Rights and Harassment Office. 
  • Draft concise, professional written reports presenting steps taken in investigations, investigative findings, and relevant documentation/evidence for review by involved parties and other stakeholders as needed. 
  • Collaborate with applicable parties to make recommendations and implement reasonable supportive measures in the resolution of complaints. 
  • Deliver presentations, training and other educational programming to local management and employees. 
  • Participate in the collection of data and in the build of robust case files in preparation for reports, presentations, and other publications required by law. 
  • Ensure the language in the Code of Conduct for matters involving harassment and human rights aligns with (and when necessary, is updated) the applicable harassment policy.
  • Maintain a high level of cultural competence, overall responsiveness, attention to detail, and the ability to exercise excellent and unbiased judgment and reasoning, free from any conflict of interest. 
  • Continuously identify and integrate best practices in related regulatory investigation fields. 
  • Perform other duties as assigned 


  • Relevant legal education
  • Human Resources, employee relations, conflict resolution and investigation training 
  • Knowledge, training and experience in issues related to harassment and misconduct
  • Knowledge of US employment legislation 
  • Strong writing skills are required
  • Excellent listening and communication skills
  • Effective interviewing skills are essential
  • Ability to work in a high-pressure environment and multitask
  • Knowledge of and proficiency in Microsoft Office (i.e. Word, Excel, Power Point, Outlook)
  • As applicable, and based on travel restrictions, requirement to travel to conduct investigations
  • Possesses an ability and commitment to maintain confidentiality and remain impartial in complex and emotionally charged situations.
